Intellectual Property Law in Dubai and the UAE: Protecting Creativity and Innovation

Intellectual Property (IP) Law in the United Arab Emirates is a vital legal framework designed to protect mental creations and human innovations. Key Aspects Covered by Intellectual Property Law:

IP law in the UAE is divided into several main branches, each with its own specific federal law:

  1. Trademark Law (Federal Trademark Law No. 36 of 2021):

    • Protection: Protects trademarks (names, logos, symbols, colors, sounds, three-dimensional shapes) that distinguish a company’s goods or services from others.
    • Registration: Legal protection for a trademark begins with its registration at the Ministry of Economy in the UAE. Registration grants the owner exclusive right to use the mark and allows them to sue anyone using their mark without permission.
    • Infringement: The law defines cases of trademark infringement and the penalties resulting from them, in addition to procedures for stopping infringement (such as seizure of counterfeit goods).
  2. Copyright and Related Rights Law (Federal Decree-Law No. 38 of 2021 on Copyright and Related Rights):

    • Protection: Protects innovative literary, artistic, and scientific works (such as books, computer programs, music, films, photographs, architectural works).
    • Registration: Protection is automatic upon creation of the work and does not require registration, but registration with the Ministry of Economy provides strong proof of ownership in case of dispute.
    • Duration: Copyright protection typically lasts for the author’s lifetime plus 50 years after their death.
    • Related Rights: Protects the rights of performing artists, producers of sound recordings, and broadcasting organizations.
  3. Patent, Industrial Designs, and Integrated Circuits Law (Federal Decree-Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights):

    • Patents:
      • Protection: A patent is granted for new, inventive, and industrially applicable inventions (such as new products, improved industrial processes).
      • Duration: Provides exclusive protection to the inventor, typically for 20 years from the application filing date, preventing others from manufacturing, selling, or using the invention without permission.
      • Registration: Protection requires registration with the Ministry of Economy.
    • Industrial Designs:
      • Protection: Granted to protect the external shape or appearance of a product (the aesthetic rather than functional aspect).
      • Duration: Typically 10 years, renewable.
    • Integrated Circuits: Protects the topographical designs of integrated circuits.
  4. Trade Secrets:

    • Although there isn’t a specific and comprehensive standalone law for trade secrets, their protection is covered through provisions in the Civil Law and Commercial Law related to contracting and liability, and the Penal Code (in cases of betrayal or unlawful appropriation).
